    -68- t CLAIMS 1. An apparatus for including a code having at least one code frequency component with an audio signal, 5 comprising:masking evaluation means for evaluating a masking ability of an audio frequency component set within a predetermined frequency range to mask the at least one code frequency component to human hearing to produce a 10 first masking evaluation, the masking evaluation means being operative to (a) detect a magnitude of the audio frequency component set, (b) determine a first masking factor on the condition that the magnitude of the set is being contributed by an audio frequency component at a 15 first frequency within the predetermined frequency range, (c) determine a second masking -factor on the condition that the magnitude of the set is being contributed by an audio frequency component at a second frequency within the predetermined frequency range and 20 different from the first frequency, and (d) to select one of the first and second masking factors;and amplitude assigning means for assigning an amplitude to the at least one code frequency component based on the selected one of the first and second 25 masking factors.

    The apparatus as claimed in any preceding claim, wherein said amplitude assigning means is operative to assign the amplitude to the at least one code frequency component based on a number of the code frequency components present within a critical band of the audio frequency component set.

    The apparatus as claimed in any preceding claim, wherein the masking evaluation means being operative to select that one of the first and second masking factors representing the lesser ability to mask the at least one code frequency component.

    The apparatus as claimed in any preceding claim, wherein said first and second frequencies reside on opposite ends of the predetermined frequency range.

    A method of including a code having at least one code frequency component with an audio signal, comprising the steps of:evaluating a masking ability of an audio frequency component set within a predetermined frequency range to mask the at least one code frequency component to human hearing to produce a first masking evaluation, the masking evaluation being performed by (a) detecting a magnitude of the audio frequency component set, (b) determining a first masking factor on the condition that the magnitude of the set is being contributed by an audio frequency component at a first frequency within the predetermined frequency range, (c) determining a -70- second masking factor on the condition that the magnitude of the set is being contributed by an audio frequency component at a second frequency within the predetermined frequency range and different from the 5 first frequency, and (d> selecting one of the first and second masking factors;and assigning an amplitude to the at least one code frequency component based on the selected one of the first and second masking factors. 10

    The method as claimed in any of Claims 8 to 10, 20 wherein a condition for evaluating the masking of an audio frequency component set is that at least one code frequency component is within a critical band of the audio frequency component set.

    The method as claimed in any of Claims 8 to 11, wherein the amplitude assigned to the at least one code frequency component is based on a number of the code frequency components present within a critical band of the audio frequency component set. 30

    The method as claimed in any of Claims 8 to 12, wherein the masking evaluation selects that one of the first and second masking factors representing the lesser ability to mask the at least one code frequency 35 component. -71 -

    The method as claimed in any of Claims 8 to 13, wherein, the first and second frequencies reside on opposite ends of the predetermined frequency range. .
