    A data rate controller system (600) for providing control instructions (610, 626, 636) to a plurality of channels (604, 620, 630, 702, 704, 706) on corresponding channel devices adapted to operate on a network, the system (600) comprising:at least one channel (604) with means for detecting background noise conditions;at least one encoder provided for running at a certain data rate on each channel device;and a central controller (602) for interacting with the plurality of channels (604, 620, 630, 702, 704, 706),    wherein: - the background noise of an inbound signal derived from a source is used by the central controller (602) to determine whether a channel in an associated device should switch from one data rate to another, with the central controller (602) adapted to send a control instruction (610, 626, 636) to each channel (604, 620, 630) to facilitate implementation of the encoder;- the background noise conditions are determined to be greater than a set level of -45 dBm;and - the system (600) is adapted to utilize a profile of possible encoders that would be supported by a particular network configuration, whereby the plurality of channels (702, 704, 706) is associated with at least one channel encoder, and has a set of encoder standards, whereby each path (710, 712, 714) in the network (708) has a certain profile of capabilities that have been derived from various factors comprising the network capability and the processor resource capabilities of the various devices using the channels (702, 704, 706), whereby the profiles are designed so that if each channel (702, 704, 706) chooses to run a certain standard, the network and processor resources will be within the capabilities of the system.

    The data rate controller (600) of Claim 1, characterized in that further the resource and network utilization (608, 624, 634) information from each channel is used by the central controller (602) to determine the type of encoder that should be run on each channel device.

    The data rate controller (600) of Claim 2, characterized in that the control instruction (610, 626, 636) is adapted to facilitate upspeeding the encoder if the network utilization is low.

    The data rate controller (600) of Claim 2, characterized in that the control instruction (610, 626, 636) is adapted to facilitate using a more complex encoder if the resource utilization information is low.

    The data rate controller (600) of Claim 2, characterized in that the central controller (602) is adapted to determine an encoder that can support the call in light of the system resource utilization (608, 624, 634), and generates the control instruction (610, 626, 636) based upon this determined encoder.

    The data rate controller (600) of Claim 12, characterized in that the control instruction is adapted to cause a lower-rate encoder to be used on at least a portion of the channels if the network congestion is high.
