A land mobile radio (LMR) comprising:a processor configured to receive as a user input a user network selection specifying one of an LMR network or a cellular data network for communicating LMR content, determine if said user network selection is acceptable for said LMR content based on at least one preprogrammed setting of said LMR, and selectively override said user network selection and cause said LMR content to be communicated over a network other than the one that the user has selected if said user network selection is not acceptable;a common LMR application module configured to generate said LMR content formatted in accordance with an LMR network protocol format;an LMR communication module configured to support a plurality of LMR services by communicating said LMR content over said LMR network using an LMR network transport protocol, said LMR communication module including said common LMR application module and an LMR transport module;a cellular data network communication module configured to support said plurality of LMR services by communicating said LMR content over said cellular data network using a cellular network transport protocol, and without conversion of said LMR content from said LMR network protocol format to a cellular network protocol format, said cellular data network communication module including said common LMR application module, an LMR encapsulation module and a cellular radio modem;a selector coupled to said LMR communication module and said cellular data network module;and an input/output module configured to communicate to and from an LMR network and a cellular network;wherein said processor is further configured to select one of said LMR communication module and said cellular data network communication module to communicate said LMR content from said common LMR application module. -24CA 02608364 2012-03-07

    An LMR in accordance with claim 1 wherein the cellular network transport protocol comprises a packet switching protocol.

    An LMR in accordance with claim 1 further comprising a user interface communicatively coupled to said processor and configured to receive a user input to select one of the LMR communication module and cellular data network module for communication of said LMR content.

    An LMR in accordance with claim 1 wherein said processor is further configured to automatically select one of the LMR communication module and cellular data network module for communication of said LMR content based on at least one of an operating condition, a user setting, a predetermined setting and a type of LMR communication.

    An LMR in accordance with claim 1 further comprising a display configured to identify a selected communication network.

    An LMR in accordance with claim 1 further comprising a housing having the LMR communication module and cellular data network communication module therein and configured to provide handheld operation.

    An LMR in accordance with claim 1 further comprising a housing having the LMR communication module and cellular data network communication module therein and configured in a desktop or dashboard operating configuration.

    An LMR in accordance with claim 1 wherein the processor is configured to encapsulate said LMR content using a packet switching protocol when communicating using the cellular data network communication module.

    A multimode terminal device comprising:a land mobile radio (LMR) including a common LMR application module configured to generate said LMR content formatted in accordance with an LMR network protocol format, and an LMR communication module configured to support a plurality of LMR services by communicating said LMR content over said LMR network using an LMR network transport protocol, said LMR communication module including said common LMR application module and an LMR transport module;a cellular data network communication module configured to support said plurality of LMR services by communicating said LMR content over a cellular radio data system using a cellular network transport protocol and without converting the format of the LMR content received from the LMR, said cellular data network communication module including said common LMR application module, an LMR encapsulation module and a cellular radio modem;a selector coupled to said LMR communication module and said cellular data network communication module;an input/output module including transmission and receiving components configured for transmitting and receiving to and from an LMR network and a cellular data network;and a processor coupled to said selector and configured to select one of said LMR communication module and said cellular data network communication module for communicating said LMR content from said common LMR application module.

    A multimode terminal device in accordance with claim 10 wherein the LMR is configured to communicate LMR content over said LMR network using an LMR protocol and the cellular data network communication module is configured to communicate LMR content over said cellular radio data system using an LMR-overcellular protocol. -26CA 02608364 2012-03-07

    A multimode terminal device in accordance with claim 11 wherein the LMRover cellular protocol comprises a packet switching protocol, and said LMR encapsulation module is configured to encapsulate said LMR content using a packet switching protocol when communication using the cellular radio modem.

    A multimode terminal device in accordance with claim 10 wherein the LMR is configured to communicate said LMR content over said LMR network using one of a Project 25 (TIA 102), an ETSI TETRA airlink protocol, an OpenSky M/A-COM proprietary format, a NetworkFirst and an ED ACS system proprietary format.

    A multimode terminal device in accordance with claim 10 wherein the cellular data network communication module is configured to communicate said LMR content over said cellular radio data system using one of General Packet Radio Service (GPRS), Enhanced Data Rates for GSM Evolution (EDGE), Evolution Data Optimized (EV-DO), Universal Mobile Telephone Service (UMTS) and 802.11 system standard.

    A multimode terminal device in accordance with claim 10 wherein said processor is further configured to automatically select for communication of LMR content one of the LMR communication module and cellular radio modem based on at least one of an operating condition, a user setting, a predetermined setting and a type of LMR communication.

    A multimode terminal device in accordance with claim 10 further comprising a user interface communicatively coupled to said processor and configured to receive a user input to select for communication of LMR content one of the LMR communication module and the cellular radio modem.

    A method of communicating land mobile radio (LMR) content using a cellular data network, said method comprising:receiving, at an LMR, as a user input a user network selection specifying one of an LMR network or a cellular data network for communicating said LMR content;-27CA 02608364 2012-03-07 determining if said user network selection is acceptable for said LMR content based on at least one programmed setting of said LMR;selectively overriding said user network selection and causing said LMR content to be communicated over a network other than the one that the user has selected if said user network selection is not acceptable;generating, at said LMR, said LMR content formatted in accordance with an LMR application layer protocol format;encapsulating the LMR content at said LMR using an Internet Protocol (IP) packet switched header in accordance with an IP layer, said encapsulating exclusive of any intermediate presentation or session protocol layer between an LMR application layer protocol and said IP layer;communicating said LMR content over said cellular data network using at least one cellular network transport protocol if said cellular data network is selected for communicating said LMR content and said selection is not overridden, the LMR content communicated over said cellular data network without conversion of said LMR content from said LMR network protocol format to a cellular network protocol format;and communicating said LMR content directly from said cellular data network to an LMR base station over a packet switched LMR infrastructure using said IP packet switched header.
