(57) Summary
A drain assembly is provided that includes a drain pipe with a threaded portion and a nut. The drain pipe includes a first end, an elbow portion, and a second end. The first end includes an annular flange and the threaded portion. To interconnect the drain assembly to a bathtub, the second end of the drain pipe is inserted through a tub drain port until the ring flange butts a bottom wall of the tub. The nut is then threaded into the threaded portion of the drain pipe to secure the drain pipe to the tub. The second end of the drain pipe is then interconnected to the drain plumbing.

The traditional method of interconnecting a drain and plumbing associated with a bathtub generally comprises attaching a flange associated with the drain pipe to the bottom surface of the bathtub while aligning a flange opening and the bathtub drain outlet, which is a concealment operation. Next, while maintaining the flange position, a filter body, including an outwardly extending flange, is inserted into the drain outlet and interconnects to the drain pipe where the flange of the filter body attaches to the inside surface of the bathtub. The filter body has a threaded outer surface that interfaces with the threaded inner surface of the drain pipe. Pressing the filter body onto the drain pipe rigidly couples the drain pipe to the tub. Often, a seal is also placed between the drain pipe flange and the bottom surface of the tub. The traditional installation method is troublesome and difficult as it requires multiple components to be kept in place during assembly.
Also, traditional drain assemblies are difficult to test. More specifically, pipes associated with the bathtub drain and the overflow outlet should

undergo leak test after installation. Leak testing involves filling the entire plumbing system with water through a vent connected to the drain. After a predetermined amount of time, leaks will be apparent if the water level in the vent pipe drops. To perform the leak test, the drain outlet and the overflow port are sealed or otherwise sealed. Due to the risk of damage, plumbers prefer not to use the end stop valve, i.e. shutter, to block the drain. Therefore, the common test method requires the removal of a plumber supplied plug, which adds a stage to the installation method.
Thus, there is a long-standing need for a drain assembly that can be installed by an individual that also facilitates leak testing.
It is an aspect of the present invention to provide a drain assembly that can be installed by an individual. More specifically, in one embodiment of the present invention a drain pipe having a threaded outer surface receiving a nut is provided. The top edge of the drain pipe includes an outwardly extending flange that engages the interior surface of the tub. The nut threadedly couples the threaded portion of the drain line from under the tub

As used herein, a 'tub' may include, but is not limited to a bathtub, shower base, or any other fluid retention basin. Because the drain pipe is placed inside the outlet from inside the tub and secured with the nut after the drain pipe is supported by the underside of the tub, an individual can install the drain assembly contemplated. After associating the drain pipe with the tub, the plumber can interconnect the drain pipe to the drain plumbing.
In one embodiment, the drain line includes a first end, a second end, and an elbow placed between them. In one embodiment, a maximum diameter of the second end, the elbow portion, and a substantial portion of the first end is less than the diameter of the drain port. In this way, the second end of the drain pipe can be placed through the tub drain port and effectively hang from the bottom surface of the tub. More specifically, the first end includes an annular flange that has a maximum diameter that is larger than the diameter of the drain port. When positioned in this manner, the threaded portion will be placed at least partially on the outside of the tub. The threaded portion has a maximum diameter that is less than the diameter of the

drain port, and is configured to threadedly receive a nut. A sealing element can be provided between the bottom surface of the tub and the nut to improve the interconnection between the tub and the drain port.
In one embodiment, a drain pipe accommodates at least one selectively removable membrane, an integrated filter body, and a drain seal. The drain plug can also be selectively removed from the drain line. The drain closure, that is, the plug, is operatively interconnected to the drain pipe by a support post that is interconnected to the crossbars integrated into or selectively associated with the drain pipe. For example, the cross members of one embodiment are associated with a ring that is threadedly secured to an interior surface of the drain pipe or interference fit in the drain pipe.
Other embodiments of the present invention do not require a filter body. More specifically, a hole or threaded reinforcement for receiving a drain plug can be integrated into the elbow or other portions of the drain pipe. In addition, crosspieces and buckets for receiving drain plugs can be integrated into the drain pipe. In yet another embodiment of the present invention, the cross members receive a .3? Regardless of whether a filter body or other member is used to receive a drain plug assembly, embodiments of the present invention are capable of receiving plugs of various types and manufacturers. More specifically, Push / Pull drain closure devices, which are described in United States Patent No. 6,418,570, Raise and Turn drain closure devices, which are described in United States Patent No. 5,758,368, and Pressflo ™ Drain Closure Devices, which are described in US Patent No. 6,226,806, can be accommodated. This list is not exhaustive, and someone of skill in the art will appreciate that other drain closure devices can be used in conjunction with the contemplated drain pipe without departing from the scope of the invention. In addition, claims hiding devices, such as Quick Trim ™, which are described in US Patent No. 7,503,083 can be used with the drain pipe described herein. All of the foregoing patent references are incorporated herein by reference.
It is another aspect of the present invention to reduce

leak points in the drain assembly. More specifically, one embodiment of the present invention employs an elbow that integrally interconnects with a straight portion of the drain pipe that interconnects to the home plumbing system, for example. In this embodiment, the elbow is fused, emptied, or molded together with the linear portion of the drain pipe. This eliminates a cut, which is often required to couple the linear portion of the drain pipe to the elbow. In addition, a sealing gasket is also removed. Someone skilled in the art will now appreciate that reducing the joints is advantageous.
Drain pipe, and related components can be made from common materials used in the art, including, but not limited to, copper, PVC, plastic, or any other suitable material.
It is another aspect of the present invention to provide a drain assembly adapted for interconnection to a tub having a drain port formed in a bottom wall, the drain port has a diameter, the drain assembly comprises: a drain pipe that includes a first portion, a second portion, and an elbow portion placed between them, and integrally connects the first portion and the second portion, the first portion includes an annular flange and a portion

Referring to Figures 1-11, a bathtub 2 includes a drain port 6 provided in a bottom wall 10 and an overflow port 14 provided in a side wall 18. A drain assembly 22 interconnects to the bottom wall 10 and it is associated with the drain port 6, and an overflow assembly 26 interconnects to the side wall 18 and is associated with the overflow port 14. A T-connector 30 interconnects the drain assembly 22 and the overflow assembly 26. The drain assembly 22 includes a drain pipe 34, which may be generally L-shaped, which connects to the bath 2 with a nut 38. The drain pipe 34 has a first end 50 associated with the bottom wall 10 of the bath. 2, and a second end 54 that interfaces with the T-connector 30. The first end 50 includes an annular flange 58 and an externally threaded portion 62. A membrane 66 can be interconnected to the first end 50 of the drain line 34 to aid in leak testing.

includes drain assembly 22, overflow assembly 26, and T-connector 30, then leak tested. Finally, a drain closure is operatively associated with the first end 50 of the drain line 34. In the above form, a simple individual can interconnect drain assembly 22 to drain port 6 of bathtub 2.
The membrane 66, or diaphragm, is sealed at the first end 50 of the drain line 34 at the annular flange 58 for leak testing. In one embodiment, membrane 66 is automatically sealed in first portion 50, and can be constructed of a material that can be easily punctured or removed. For example, membrane 66 can be constructed of a plastic, flexible rubber, or the like material. After a successful leak test, a plumber can remove membrane 66 with a pointed object, as described in related United States Patent No. 8,302,220.
In most cases, a drain closure 82 is associated with the first end 50 of the drain line 34. The drain latch 82 can be of any conventional type, including Lift and Turn, Foot Operated, or PUSH-PULL ™ latches to name a few, which are mentioned above. Likewise, a PRESFLO ™ drain closure, such as that described in US Patent No. 4,457,030 to Burry and US Patent No. 6,226,806, which are incorporated for ίΓ Ti ® K μη π

Reference herein, can be used in conjunction with some embodiments of the present invention. Drain pipe 34 may include a cross member 86 and hub 98, which are typically found in felt bodies. The hub secures a carrier that operatively receives the shutter. Transom 86 may be integrated into the drain pipe or otherwise interconnected therewith. A cover 90 can be secured to flange 58 to substantially cover some and provide a finished appearance. Cover 90 may be comprised of a trim device that effectively conceals annular flange 58 as described in United States Patent No. 7,503,083 and United States Patent Application Publications Nos. 2011/0209279 and 2013/0055494 , which are incorporated herein by reference.
Figures 3 and 4 show other methods that interconnect drain line 34 to primary drain 57. In Figure 3, the drain includes an elbow extending from the annular flange 58. Elbow 34 is interconnected to a pipe 56 by means of an adapter 55. Pipe 56 is also interconnected by a T-connector 30 that connects the primary drain 57 to a pipe associated with the overflow assembly (see Figure 1, for example) . In Figure 4, the drain assembly includes a vertically oriented pipe that extends from flange 58

cancel. The drain assembly 22 is directly interconnected to the T-connector 30 which is also interconnected to the primary drain 57 and to a pipe 5 6 associated with the overflow assembly. These two alternative methods to interconnect drain assembly 22 provide more installation options and flexibility to the plumber. Those of skill in the art will appreciate that various other ways can be employed to interconnect the drain assembly 22 to the overflow assembly and the primary drain plumbing 57 of the home. For example, the portions of drain assembly 22 that interconnect to T-connector 30 or primary drain 57 may be flexible as described in US 2008/0196161, which is incorporated herein by reference.
Figures 6-12 show the drain line 34 of an embodiment of the present invention, which is comprised of a first end 50 that includes the outwardly extending flange 58. The threads 62 mentioned above are located under the flange 58. A second end 54 of the drain pipe 34 is connected to the first end 50 by means of an elbow 78. Because the space is limited under the bath, it is advantageous minimize elbow size. However, the elbow must be large enough to allow installation over the bath and to accommodate the nut. it is interconnected to the second end 54, which can be schedule 40 pipe, by means of common plumbing interconnection methods. In another embodiment of the present invention, the first end 50, elbow 78, and the second end 54 are created in a molding process and thus comprise a single unit. The second end 54 of an embodiment meets the dimensions and tolerances of Schedule 40 so that they can be received in common drain fixtures. Furthermore, the second end, which comprises a generally horizontal portion of the drain line 34, may be at an angle of approximately 0.25 ° with respect to the horizontal plane defined by the outwardly extending flange 58. Also as shown in the
Figures 11 and 12, the first end 50 can be threaded on an inner surface thereof, which will be described in detail below. Furthermore, the first end may include a flange 118 to receive the closure member, as well as a membrane 66, which will also be described below.
The threads 62 are formed in such a way that they facilitate the insertion of the drain pipe 34 in the drain port of a bathtub. In an embodiment of the present invention, the threads 62 have a square or round profile (without a tip), that is, , are comprised of recessed rectangles, so that they fit easily within the drain port of the bathtub. Because the pipe

Drain should be adjusted through drain port openings as well as approximately 5.8 centimeters (2.0 inches) in diameter, the main diameter of the threaded portion cannot be greater than the diameter of the drain port. The smaller diameter of the threaded portion cannot be less than the diameter of the drain pipe. The length of the threaded portion should be long enough to accommodate the bottom wall thickness of the tub, but small enough not to adversely affect elbow size 78.
Drain line 34 of one embodiment of the present invention is formed of PVC by ASTM D1784-90, class 12454-B, and is mechanically performed by ANSI / ASTM D-246690A. Furthermore, the drain pipe 34 can be formed of PVC with white pigment that can be laminated in chrome.
Figures 13-15 show the nut 38 used in some embodiments of the present invention. Nut 38 includes internal threads 150 that selectively couple the external threads of the drain line. Nut 38 also generally includes frusto-conical top surface 154 and bottom surface 158. The upper and lower surfaces may alternatively have a concavity for receiving a sealing member, which can be described in detail below with respect to Figures 16-19. INDUSTRIAL which can have a profile commensurated so that the drain pipe threads are designed to fit over a schedule 40 drain pipe and are able to traverse the elbow without binding or difficulty.
Figures 16-19 show the sealing member 114 used with some embodiments of the present invention. The sealing member 114 is designed to fit over the second end 54 of the drain pipe, transition around the elbow, and engage on the bottom surface of the tub as shown in Figure 2. The sealing member 114 is maintained in place by the nut, which compresses the sealing member 114 against the bottom surface of the tub when it is tightened. The contemplated sealing member 114 provides a watertight connection, which may allow installers to forget the use of a sealing putty. In one embodiment of the present invention, the seal is formed from an elastomeric material having a density of approximately 0.999 g / cm<sup>3</sup> (0.0361 pounds) per cubic inch and weighs approximately 0.011 kg (0.025 pounds). The surface area of the sealing member 114 is approximately 59.35 cm<sup>2</sup> (9.2 inch<sup>2</sup>). The sealing member 114 of this embodiment of the present invention may further include an upper boss 162 and a lower boss 166 which are positioned internally to the outer surface 170 of the sealing member 114. Protrusions are designed to interconnect with the frusto-conical surface of the nut to facilitate the tight interconnection between the drain pipe and the tub.
Figure 20 depicts one embodiment of a drain assembly 22 that includes a drain latch 82 interconnected to a stud insert 94. Transom insert 94 includes a hub 98 having a threaded opening 102 configured to receive a threaded end of a holder 106 which slidably receives drain closure 82. Carrier 106 is inserted through a filter body cover 110, which interfaces with flange 58. As in the embodiments described above, a nut 38 is threadedly engaged on threaded portion 62 with a sealing member 114 placed therebetween.
Figures 21 and 22 illustrate one embodiment of a drain assembly 22 employing a membrane 66 and a stud insert 94 having a threaded hub 98. Membrane 66 is placed on at least a portion of flange 58 or attached to annular flange 118 of drain seal 34 at first end 50 of drain elbow 34. Annular flange 118 is formed on the top surface of annular flange 58 as flange 58 transitions into inner surface 122 of first end 50 of drain line 34. In an alternative modality, the

annular flange 118 is formed on an inner surface of the first end 50 of the drain line 34. The annular flange 118 can be configured to interconnect various devices to the drain line 34, including, but not limited to, a membrane 66, a cover 110, and a filter body.
Referring to Figures 22 and 23, various ways of placing cross members within the drain pipe are depicted. In one embodiment, crosspiece 94 adjusts by interference in drain line 34. Transom insert 94 includes at least one transom 86 that interconnects an annular ring 126 to hub 98. Hub 98 may include a threaded opening 102 configured to threadably receive the threaded end of a holder, which operatively receives a drain closure 82.
Referring to Figures 23-27, a stud insert 94 includes a threaded annular ring 126 that threadably engages a threaded portion 130 of drain line 34. Cross member insert 94 may alternatively have a smooth outer surface for interference fit within the ID of drain pipe 34 as shown in Figure 22. Alternatively, cross members 86 may be integrally formed in drain line 34 as shown in Figure 28.

Figures 29 and 30 illustrate other methods of integrating a bucket for receiving a drain shutoff mechanism with the drain pipe. In Figure 29, an upwardly extending bucket 98 is integrally connected to elbow 78 of drain line 34. The hub 98 extends into an interior space near the first end 50 of the drain line 34 and includes a threaded hole 134 that receives a threaded end from the carrier 106.
Referring now to Figures 31-33, various embodiments of a drain assembly 22 using a drain seal 82 are provided. FIG. 31 depicts a drain line 34 including a concave portion 138 formed on an inner surface 122 that is configured to receive a drain seal 82 that fits or snaps into the concave portion 138 of the line 34. sewer system. In one embodiment, the concave portion 138 of the drain line 34 receives a PRESFLO ™ drain seal. Also as illustrated in Figure 32, a cover 90, which often includes a filter, can be interconnected to the drain line 34 to prevent air from entering the drain line, for example. In one embodiment, the cover 90 fits by interference on the annular flange 58 and the annular flange 118 of the drain line 34.
Figure 33 shows a drain plug insert 142 that interconnects to drain line 34 and is

OE THE INDUSTRIAL PROPERTY capable of accommodating the drain closure device, such as the PRESFLO ™ drain closure. Drain closure insert 142 may alternatively have outer threads that selectively engage threads located within drain line 34 similar to that shown in Figure 23.
The drain assembly as described herein can be used in conjunction with a foot operated drain plug as taught by US Patent Application Serial No. 13 / 912,421, filed June 7, 2013, which it is incorporated for reference in its entirety herein. The drain plug described in United States Patent No. 5,758,368 (Raise and Rotate), United States Patent No. 6,066,119 (PRESFLOW), and United States Patent No. 6,418,570 (push / pull), can be used with respect to the embodiments of the present invention. In addition, inserts, which hide the outer surface of the flange extending outward from the drain pipe, can be used in conjunction with the embodiments of the present invention. Such devices are described in United States Patent No. 5,745,931 and United States Patent No. 7,503,083, and pending patent applications related thereto. Such patents and pending applications are incorporated herein by reference.
