    Claims of equivalent WO 2004032776 A1 WHAT IS CLAIMED IS:1. An electrosurgical instrument for sealing tissue, comprising: an inner member and an outer clamping member at least one of which includes a ring handle near a proximal end thereof, each of said inner member and said outer clamping member including a seal surface proximate a distal end thereof, at least one of said inner member and said outer clamping member being movable from a first position wherein said seal surfaces are spaced relative to one another to a second position wherein said seal surfaces are disposed in opposing relation relative to one another for grasping tissue therebetween;a rod being operably connected at a proximal end to said outer clamping member and operably connected at a distal end to said seal surface of said outer clamping member, said rod being translatable to pivot said seal surface of said outer clamping member relative to said seal surface of said inner member;a stop located near the proximal end of said inner member for limiting distal movement of said push rod and to maintain a gap between said opposing seal surfaces when said seal surfaces are disposed in said second position;and means for energizing said seal surfaces such that electrosurgical energy can be communicated through tissue held therebetween when said seal surfaces are disposed in said second position to form a tissue seal.

    An electrosurgical instrument for sealing tissue according to Claim 1 wherein said inner member includes a shank portion and said outer clamping member includes a shank portion, the shank portions providing a mechanically advantageous spring load during tissue clamping.

    An electrosurgical instrument for sealing tissue according to any . preceding claim, said stop is selectively positionable to vary the separation distance between said sealing surfaces.

    An electrosurgical instrument for sealing tissue, comprising:an inner member and an outer clamping member at least one of which includes a ring handle near a proximal end thereof, each of said inner member and said outer clamping member including a seal surface proximate a distal end thereof, at least one of said inner member and said outer clamping member being pivotable within an open lockbox to move from a first position wherein said seal surfaces are spaced relative to one another to a second position wherein said seal surfaces are disposed in opposing relation relative to one another for grasping tissue therebetween, said open lockbox including a bottom surface disposed on one of said inner member and said outer clamping member which matingly receives a corresponding surface disposed on the other of said inner member and said outer clamping member;a rod being operably connected at a proximal end to said outer clamping member and operably connected at a distal end to said seal surface of said outer clamping member, said rod being translatable to pivot said seal surface of said outer clamping member relative to said seal surface of said inner member;a stop located near the proximal end of said inner member for limiting distal movement of said push rod and to maintain a gap between said opposing seal surfaces when said seal surfaces are disposed in said second position;and means for energizing said seal surfaces such that electrosurgical energy can be communicated through tissue held therebetween when said seal surfaces are disposed in said second position to form a tissue seal.

    An electrosurgical instrument for sealing tissue according to Claim 9 further comprising a pivot disposed through said bottom surface of said open lockbox for joining the inner member and the outer clamping member for pivotable rotation thereabout.
