13 claims: 10 independent, 3 dependent

  1. 1
A method for facilitating speedy packet communication or bandwidth measurement between entities on a network through a communication device applying the Nagle algorithm, the method comprising:sending (412) a packet pair (260, 262) from a sending entity (220) to a receiving entity (290, 292);and sending (414) at least one "push" packet after sending said packet pair to avert a transmission delay between the packets in the pair, wherein the "push" packet has a packet size equal to or greater than the "segment size" parameter defined by the Nagle algorithm to force the transmission of the packet pair by the communication device and avoid the transmission delay caused by packet buffering by the Nagle algorithm on the communication device on the network.
  2. 4
A method as recited in one of claims 1 or 3, wherein the communication device is a proxy server.
  3. 5
A method as recited in one of claims 1 to 4, where the network is TCP.
  4. 6
A method as recited in one of claims 1 to 5, wherein the "push" packet is sent from the sending entity.
  5. 7
A method as recited in one of claims 1 to 6, wherein the communication device comprises a device other than the sending entity or the receiving entity.
  6. 8
A method as recited in one of claims 1 to 7, wherein the packet buffering causing the transmission delay is characterized by a buffering action where one or more of the packets in the packet pair are buffered into a packet buffer, wherein the transmission delay is a result of the packet buffering action.
  7. 9
A method as recited in one of claims 1 to 8, further comprising receiving a bandwidth-calculation based upon measurements related to the packet pair.
  8. 10
A computer-readable medium having computer-executable instructions that, when executed by a computer, perform the method as recited in one of claims 1 to 9.
  9. 11
An apparatus comprising:a processor (932);a transmission-delay avoider executable on the processor to: send a packet pair from a sending entity to a receiving entity through a communication device applying the Nagle algorithm;and send at least one "push" packet thereafter to avert a transmission delay between the packets in the packet pair, wherein the "push" packet has a packet size equal to or greater than the "segment size" parameter defined by the Nagle algorithm to force the transmission of the packet pair by the communication device and avoid the transmission delay caused by packet buffering by the Nagle algorithm on the communication device on the network.
  10. 13
A data signal having data fields encoded thereon transmitted over a communications channel through a communication device applying the Nagle algorithm, the data signal comprising:a first field including a first bandwidth-measurement packet of a bandwidth-measurement packet pair;a second field including a second bandwidth-measurement packet of said bandwidth-measurement packet pair;and a third field following the second field and including a "push" packet facilitating minimization of transmission delay between the first and second packets, wherein the "push" packet has a packet size equal to or greater than the "segment size" parameter defined by the Nagle algorithm to force the transmission of the first and second packets by the communication device and avoid the transmission delay caused by packet buffering by the Nagle algorithm on the communication device over the communication channel.
